That's exactly what I want to know as well as there's no reason stated on MCOL.
That site is not user friendly.
I'm guessing it's likely to be because they filed the AOS.
The basic particulars of claim are on the claim form, I did not tick the box to provide more, though obviously if requested will do so.
As I can't see any way they can defend this, I didn't waste more of my time with more details originally.
They know what the case is about though and have all the relevant data themselves in emails and my full account history with them.
Thanks

Re: Bookmaker Sued : Var Q's Inc Change Of Location

I just received a "Notice Of Judgement Rejected" this afternoon in the post. It's dated the 20th, today is the 27th.
Reasons given: AOS filed and time for Defence not expired.

Reference Des' comment: The links you gave me clearly state at the bottom of their webpage that the bookmakers are operated by a company registered in Gibraltar.

Des, lets not forget, this is also on the same page where the fraudulent promotion is being advertised so why would anyone expect them to display the London address? I suggest that the London address is not displayed in the hope that they can try to fool everyone that Gibraltar is the only location in which they can be touched. If this were the case, then why would there be two differently named and addressed licences shown on the Gambling Commission website, one of which is in London?

I still want to maintain the claim remains with the London address on it, so what should I do please?
The date of service was 2nd April by the way.

can you PM me a link too (I'm nosey :lol ... if des8 says that the company is registered in Gibraltar, I have no reason to doubt him, but I like to check things out myself
RandomUsername ... I take it you completed the company's internal complaints procedure before starting a claim?? Have you proof of the company accepting 'official' correspondence at the London address etc...??

Re: Bookmaker Sued : Var Q's Inc Change Of Location

hi kati thanks, I just sent you a PM.
yes i completed their internal complaints which i have evidence in emails.
i didn't use IBAS because a previous complaint with them was farcical even though ultimately successful.
this complaint is more serious though because it's fraud and due to the time involved i wanted to be compensated for such.
good question about the london address accepting official correspondence.
they would have accepted the initial correspondence from the court there wouldn't they? would that count?
how else would they have known otherwise?
i sent them a final warning on 1 March 2016 to their london address prior to issuing the claim.
i thought i'd done so by recorded delivery but can't find the receipt to hand, will look further into that.
re that link litigation in gibraltar, looks very technical so will look later.
thanks

Re: Bookmaker Sued : Var Q's Inc Change Of Location

Correspondence & licensing addresses wouldn't be relevent to the consideration of where the company is registered.

Did they indicate on the acknowledgement that they were intending to contest the jurisdiction?

It's no surprise there's so much "legalised crime" in the world then.
No they haven't referred to contesting the jurisdiction on the AOS.
The orig claim was deemed served 2nd April, they have 28 days from date of service, assuming the 2nd counts as one of those days (does it?) then I could try entering judgement again on Friday the 29th? If so, after what time please?
Thanks

http://legalbeagles.info/forums/show...it-Court-Claim

The defence date is 28 days from service (ie when you received the claim) or 33 days (which allows 5 days for service) from the issue date printed on the front of the claim form. You can work out the date HERE >>> http://www.timeanddate.com/date/dateadd.html

Re: Bookmaker Sued : Var Q's Inc Change Of Location

The defendant has now filed a defense. Firstly they are still trying to change the location, but secondly this has now reached a point whereby I am considering reporting the matter as a crime. I already deem the issue itself to be have been fraud, but is the defendant now committing an offense (contempt of court?) by quoting to the court in their defense:

1. T&C's that they know were NOT those shown at the time the transactions were taken
2. Quotes as still advertised on their site today but with a word REMOVED in their defense clearly in order to deceive the court

I have photographic and video evidence of all of the original advertising and T&C's recorded back then. Should I immediately report this to the Police, obtain a crime reference number, and inform the court of these issues?

Thanks

You have nothing to lose if you contact the Police as to it being criminal may be or may not

Have the Defendants claimed no jurisdiction in their defence or have they simply put the Gibraltar address as the address for service of documents ?

No, submit your screenshots and T&C copies as part of your evidence bundle / witness statements.

Re: Bookmaker Sued : Var Q's Inc Change Of Location

I think I am about to sort out the jurisdiction issue thanks to some advice from elsewhere.

I believe I have found several areas of Consumer legislation that will enable me to claim for damages, which would include financial loss of earnings etc incurred in having to spend the number of hours required on this. I have a Particulars Of Claim of a few pages in length, which includes reference to the various acts and details in depth of how the claim arose. Is there anyone on here that would be prepared to look through the document please and advise accordingly?

Thanks
