  • Car sold with dodgy MOT

    Hiya
This will be a long one.

I bought a 2nd hand Audi s3 which i paid just under 11k for on 20/11/15 i also bought gap year insurance £395 and a 2 year gold+ warranty £595. I also paid for an indipendant inspection of the vehicle. And was advised that the tyres were on there limit for legal depth of tred, the breakpads were in need of replacement and that the aircon didnt work, plus afew other minor issues.

I told the garage about my concern regarding the tyres and they said they would replace the tyres or do the brake pads and would regas the aircon as this was also mentioned in the report, which i emailed to them upon request, i choose for them to replace the brake pads as i wanted good tyres on the car not cheap ones.

After about 50 miles of driving an emmision warning light came on. I took the car to a local garage the next day and they plugged it up and told me the issue, bank 6 on the catalitic converter had an issue, they said it sometimes can be cleared by driving the car hard for 10 min or so and that it may be burning more fuel than needed, not much to worry about, they cleared the fault on the dash and i left. After another 80 miles the light came back on. I then went on holiday over christmas and completely forgot that i was supposed to get paperwork through confirming that the warranty was set up (within 28 days). I remembered after reading through my paperwork, as i was looking to check if the issue i was having was covered, the car drives fine and i am happy with it.

I had not received any paperwork. When i spoke to the warranty company, at the end of january 2016, they had the car reg no. but had the wrong name and address with it. They said they would look into it and get back to me, after leaving my name, tel no and address. A week passed and i'd heard nothing so i rang them back, they still had the wrong name and address linked to the car reg so i was very unhappy and asked to speak to a manager. After a few min of talking they still kept using the wrong name when talking to me even though i had given them my name at the begining of the conversation. So i said i was unhappy and wanted to cancel the warranty as id lost confidence in them as a company. I informed them i would be ringing the car sales company and would be requesting a refund. I emailed them this info as they requested me to do so. Again i was informed it would be looked into and contacted. After hearing nothing from them for 3 weeks i rang the salesman of the company i bought the car from and outlined the issues i was having with the warranty sold to me.

He told me that the person who deals with warranties had just returned from holiday and he didnt want to bother him that morning with it. And that as it had been over 30 days (cooling off period) there was little that could be done. I informed them that i would be seeking legal advice about my position on getting a refund (for the warranty only, as i was happy with the car otherwise)
I have since spoken to CAB and was advised to send a letter asking for a refund in regards to breach of contract.

On the way to the Post office to send the letter, recorded delivery, i was stopped by the police and informed that my license plates were illegal. As these plates were on the car when purchased, and it was only MOT'd 2 days before purchase with those plates on it, i am now very curious as to how the car passed its MOT.

I have now added to the letter regarding the refund of money paid for the warranty, with my concern over the illegal plates and MOT. And that i would be requesting reimbursment for the cost of the license plates. And would be putting the car through an MOT to check for any other issues and would be in touch if any are found.

My main concern is was the car even MOT'd properly or am i going to get a huge bill next time i need to MOT the car due to emmisions, thinking about the warning light.

Just trying to plan ahead as to my next course of action if they either a) dont reply or b) get a bit arsy with me.

Any advice would be much appreciated. Thx

I think you are probably worrying too much.
You said you had an independent inspection of the vehicle, presumably by a qualified engineer, and this only threw up minor problems.
You also say you are happy with the vehicle.

In what way were/are the registration plates illegal?
Registrationplates should only be rejected by MOT inspectors for character dimensions or spacing if they areclearly incorrect.
Possibly incorrect, but not a failure

The pc that stopped me said that mine were made from metal and that when a camera takes a photo of them they dont show up unless they mess with the polarity, or something similar cant remember his exact words, of the photo, have a black border around the outside, dont have a british standard mark in the bottom right corner, dont have the place i got them from at the bottom middle of the plates and also that they have a "D" inside the euro emblem on the left so are German or Dutch not British plates.
My neighbour is an MOT inspector, i asked him and he says their illegal too.

The plates might be illegal, but that doesn't automatically make them fail an MOT

Did plod give you a "producer", or was it just a verbal?

The lack of British standard marks and makers name are not referred to in the testers manual

I got a producer and a £100 fine. I have to replace the plates.
