This is a dealer pretending to be a private seller to avoid his responsibilities.
He is also probably fiddling his tax returns!
Advise DVLA you are the new keeper of the vehicle you purchased but you haven't been given V5C. You are responsible for ensuring road fund licence is paid from time of purchase.
Assuming you don't really want your old vehicle returned, send him the V5C for your old vehicle and advise DVLA that the new keeper of your old vehicle is a trader by name of>>>>>>>>>.
Write to him a "Letter before Action" giving him the option of arranging repairs, or paying for them when you have had them carried out.
