I have been advised by the financial service collections team VW that I can voluntary return the car I have on hire purchase. This resulted during and on conclusion of a complaint about the goods when mechanical failure occurred which is recorded as a fault worldwide. The finance company have refused to repair the vehicle citing age of the vehicle. The car has been at the dealership 10 weeks (still there) and 8 weeks of this was the finance companies timescale for the complaint.
The finance company stated they will accept voluntary termination over the telephone? of the hire purchase as I have paid 53%. They have stipulated that I have to be present and sign when the car is collected. Also I will be charged if it does not have a service book and 2 keys etc. They are in full knowledge that repairs have not been carried out on the car and that during this time the mot has elapsed. I have now been contacted by Burlington group collections/litigation as the representative of the finance company to collect the car.
This is worrying me as the finance team seemed to push for the voluntary termination. They have not taken my last two payments during the complaint and I have not refused to pay these. I have had verbal assurance that I will only be liable for these two payments even given the issue with the car. Is there anything I should be worried about here? Do I have to sign documents on collection as they insist? What has to go with the car (documents etc.,).
