  • Fault with Leather and Frames on Sofas?

    Hi,

    We have three leather sofas, purchased 3 years ago and have an extended warranty with a reputable company which covers the fabric and structure.

    We have had the company out twice to touch up the leather where it is wearing on the seats.

    On purchase we paid for the best quality leather, but in our opinion the leather is looking really worn and old, particularly for the usage and care we take. Plus the amount of money we paid.

    We now need to have them back to the terrible wearing of the seating areas of the leather again, and with two of the settees the frames have dropped to one side, nearly touching the floor.

    My question is, should we contact the Retailer and would the Sale of Goods Act cover us for a replacement?

    Any advice would be most appreciated.

    Hi and welcome,

    the Sale of Goods Act 1979 requires goods are of a satisfactory quality. An implied term is that they last a reasonable time.
    Retailers will often allege the item has failed due to misuse, and it is for the purchaser to demonstrate the contrary.

    Without actually seeing the sofas and knowing the price paid etc it is difficult to be precise, but it would seem that you have a case,at least for repair.
    You are unlikely to obtain a replacement, and if you were to try for a refund a successful claim would take into account the fact you have had 3 years use
