    In January I had cctv installed following a series of robberies locally. I was assured that the system we had installed kept a history for 30 days, on a rolling basis. This was important as we are away on business for periods of time and I wanted to rely on a recording should I need to - the installer assured us many times that this was the case.

    Earlier this month there was a break in to our premises when we were away. The entry site was directly in the line of the cctv, so we were reassured that we would have good footage.

    However when we went to retrieve the images, this functionality was not available. The installer was mortified and immediately admitted that he had installed a lesser quality system without the rolling back up. I am fuming. Not only have i paid for a lower quality system but I also have lost stock and cannot produce evidence which I could use to give the police.

    The installer has offered to upgrade us to what we originally paid for. Nice ! I think this is taking p*ss. He fails to recognise why I'm so angry and thinks a simple upgrade will suffice. I want a full refund and I'm also minded to sue him for the stock we have lost directly as a result of the failure of his system.

    Any advice please?

    He misrepresented the goods, therefore hes liable to compensate you for your direct loss incurred as a result of the goods not being as described - However the loss of stock is not a direct loss associated with the installers/sellers misrepresentation of the CCTV system as the break in was unforeseen and not linked to the quality of the CCTV product or the Installers misrepresentation, plus there is no guarantee the CCTV images would have resulted in any arrest or your recovering of the stock or value of it. Therefore the installers liability to you is to replace the system with one that matches his original description at no cost to you, or refund you in full.

    You can reclaim the value of stolen stock from your insurance company!
