    hi all

    I'm new to this site so thank you in advance.

    I purchased a 57reg Audi A6 2.0tdi from a dealership in Wembley on 19/05/2015 for the sum of £6000 (3 months warranty included). on 5/2/2015 the turbo and oil pump failed. after many calls to them and email threats of legal action, the car was recovered from my home in cornwall to a garage of their choosing on 7/2/2015. the vehicle was returned to me on 27/02/2015 with a 'new' turbo and 'new' oil pump, all carried out FOC. it now has a fault that is a direct result of the work carried out and could indeed be a faulty turbo. where do I stand on returning the vehicle to the dealer for a full refund please?


    further information:
    from the 7/02/2015 to 27/02/2015, no calls were received from the dealership and I found I had to call them for updates. for the last 2 weeks of it I was calling pretty much everyday for a return date of the vehicle as I was told it had been fixed then. after many times of 'tomorrow, tomorrow, tomorrow' and the dealership fobbing me off onto the poor garage owner it was driven back down to me by one of the garage owners family. after dropping him at the airport (he'd personally filled the fuel tank up), on the way back the latest fault became apparent. since 27/02/2015 I have call the dealership daily to sort the issue out and subsequently emailed them threatening court action as they have not answered the phone once and have picked up all of my read receipted emails.

    I'm a day away from driving the vehicle to the dealership forecourt, handing them the keys and demanding my money back but am worried that as I have had any verbal communication from them my efforts may fail.

        if you now confirm the car was purchased on 19/02/15, can you also double check your second date from post #1 (5/2/15) - could you have missed a 2 off the start (making it the 25th?) or ..... ?

            Are you sure it is a faulty turbo? an expensive part to replace!
            Have you had a report from a third party?
            As the repair is unsatisfactory you can still return the vehicle for a full refund, but you do have to stop using the vehicle.
            You have this right under the Sale of Goods Act 1979.
            If you bought the car using your credit card you could claim against the card issuer under section 75 of CCA, as you can for certain types of car finance.
            Do not drive the vehicle to Wembley.
            Write to them (again!) rejecting the vehicle as they have failed to remedy the defects, quoting SOGA 1979. (signed for)
            Request your refund and tell them to collect the vehicle which you are not using, within a limited time.
            If you think you might be claiming against your credit card supplier, or finance provider, copy them into the correspondence

              Thanks for the reply. It was DEFINATELY a faulty turbo, the thing blew as I was driving it with plumes of white smoke from the exhausts.

              As for the letters, I've written an intent to return the vehicle. My main concern is that they haven't signed for these letters no responded to the email version of the letter.

                The fault was diagnosed as an 'over boost' issue which, after speaking to an Audi main dealer is directly linked to the turbo

                  Well if it's caused by the actuator sticking you are probably looking at a new turbo.

                  I take it the dealers haven't disappeared from the scene?
                  As you're not getting a response from the garage.is there a possibility of going via creditors ?
                  If not your final move is a "letter before action"
                  I would still try one last letter to the dealers with a deadline for refund and vehicle collection, but then I don't know how many tries you've already had:tinysmile_hmm_t2:

                    There are no creditors to involve as the car was paid for in cash. All receipts have been kept obviously.

                    The dealership are still there (according to neighbours), but they are not answering the phones. Living 300 miles away has it's draw backs.

                    ive sent the letter before court and have now given the ultimatum. Where does that leave me?
