  • Hillarys Blinds not returning deposit paid with credit card

Hello, on 27/11/14 Hillarys Blinds' salesman came to my house (prearranged, but whole 7 hours late!). Wanted 3 shutters and 2 blinds installed. At the end of the meeting paid £350 deposit, after being told that I 'had to give him something' . Next morning, when I spoke to salesman, told him I've changed my mind and will want only blinds, but not shutters. 3 blinds altogether. We was v upset, and told me he will have to recalculate the costs and he will ring me same afternoon, 28/11/14. He did not ring me as promised, but only rang yesterday, 4/12/14 with the huge price of £756! For 3 roller blinds. This morning I rang the office to cancel my order because of the price, but was told I cant, as 2 day cooling period finished on 29/11/14, and the order has been placed. Still, surveyor to measure everything exactly has not been (he is supposed to come next Tuesday), so how come the order has been placed? And I want to cancel purely because of the price, which was given to me yesterday, way after 2 day cooling period.
Hillarys refusing to refund. Contacted my credit card company (Capital One) for Section 75 form. Is there any hope?
    Thank you.

Re: Hillarys Blinds not returning deposit paid with credit card

Until last June purchasers from doorstep sellers (includes those at your home by invitation) had seven days in which to cancel the order.
However in June this year there was a new European Consumer Rights Directive which removed that seven day cooling off period.

Were you given a price for the three shutters and two blinds at the time you paid the deposit? In other words did you confirm the order before knowing the price?
