  • Car Hpi Rules - Write Off

    Hi, general query.................................. we have been offered a cracking car to buy for a miniscule price. This is the thing............

    The guy who owns it, whom its registered to, had finance on it, and we think he must have got behind with the payments, and so has stored the car away where finance company cant find it, in a safe lock up a long way from where he lives. Its been approx. 12 months since any last contact from the finance company to the man that owns the car on finance. The car is still hidden away. We have now been offered to purchase this car from the guy, and our intention if we go ahead with it, is to take the car to France, to our holiday home there, and only ever use the car in France.

    Does anybody know how we stand on this. Are we committing a crime if we buy it from him........................... how would we go about getting the log book changed into our own names as the new owners, i.e. could we even get a private plate put on it, etc. etc. etc. and does anybody know how long it is before a finance company write of a loan on a car where somebody has defaulted, i.e. this guy............. before they would take the car off us if we bought it from him. Its a gorgeous car, at a bargain price, but we obviously dont want to end up liable for any of his debt, etc. etc. or have the car taken off us if they find it.

    Help, does anybody know where to find any info on this.

    TBH, If the seller is that dodgy that he is hiding a car, I would stay well clear no matter the price

        Hes already been chased in the past by the finance company................. he has a company and the car was registered to his company................... but they havent contacted him in ages, nor got any court orders etc. to get the car back, and hes just kept it hidden, but is now so skint he needs some hard cash and wants rid..................... he knows in time theyre going to chase him for the balance, but I just need to be sure that if we bought it from him cash, we could get it registered to us as the new owners, immediately take it out of the country to our place in France and keep it there for the rest of its life on french car insurance. ? Just need some advice really to ensure a) Im not breaking the law, and b) if its out of the country, his car loan firm cant make me bring it back from france. ?

          I would have to concur with PK here. If the hire purchase agreement is still outstanding and you buy this car, the finance company will retain a legal interest in it until the loan is repaid regardless of where it is.

          You would not retain good title on this vehicle in this situation. It may be possible that you could prove your status as an innocent purchaser to the finance company, but given what you have written, that is not the case and not only that it is an extremely difficult and lengthy process.

          If you knowingly purchase a car that has outstanding finance on it and further, plan to take it abroad then you are committing an offence under s.22 of the Theft Act 1968 which carries a maximum prison term of 14 years.
