Re: Problems with a purchased car

I've just sent a very long email to the CEO explaining everything and that my solution would be for stoneacre to take the car back and give me another one of equal value, is this appropriate do you think?

    TIA

Re: Problems with a purchased car

Just an update, the car got towed to the garage first thing this morning and they are only just putting it in the place to look at it ggggrrrrr, I've spoken to them and so has my husband and we have told them that we no longer want the car as it has caused us more trouble than it's worth and it is just too much hassle, so we would like them to take the car back and give us another one if the same value and like for like but obviously not a Vauxhall,
The finance manager at Rochdale has said that my husband needs to speak to the finance manager at the Wigan branch as this is where we brought it from, so my husband is there now talking to them, the faults that the AA found were all to do with the intake manifold which they replaced only a week and a half ago, which has made me really angry,

Fingers crossed they will agree to our suggestion, oh and I sent the CEO an email last night and he has not replied so maybe he is as useless as the mechanics,

          ill keep you informed

          TIA x

Re: Problems with a purchased car

            Ok another up date,
I've spoken to someone at the citizens advice who transferred me to someone at consumer rights who have taken all the details and have pointed me in the direction of writing formal letters to Stoneacre telling them all the trouble we have had with the car and that we want a replacement vehicle, as we have the rights under the sales of goods act,
At the same time my husband was with the sales manager who said that in principle they can exchange the car but they (that garage) have to look at the car first, but nothing will happen now until maybe after the new year,
In the mean time I have a courtesy car from Stoneacre and have expressed to them that we are not collecting my car wether they fix it or not,

I'll be back in touch as soon as I hear anything,

thanks again for your help x

Re: Problems with a purchased car

              Another update,
We are still driving around in a courtesy car from Stoneacre, ours is fixed but because we have told them we don't want it back they have not told us to collect it (which according to the consumer rights they can),
We have sent letters to the Garage and to the finance company (who are looking into it).
The manager of the Wigan branch has spoken to my husband on the phone and asked him would we be willing to take X car in exchange for ours subject to us taking it for a test drive, but he needs to run it past head office first he just wanted to make sure we would be willing to,
So this is where we are at now, just waiting for a call back from him regards head office,

              I'll keep ya posted xxx

Re: Problems with a purchased car

                Hi all,
                another update,
after I had spoken to the consumer rights and cleared up a little confusion between myself and them I was told that we cannot exchange the car for another as this is illegal, so we were given 2 options
Option A the garage pay off the fianance and we finance on another car or
Option B the finance company pay for repairs on the car,
Option B was not in the equation for us as the garage had already repaired the car so we started pushing our luck with the finance company and the garage, we told both companies that we were not willing for the finance to be paid off as we had paid £2000 in finance payments and we would loose that money, so we would only agree if someone paid us the £2000,

After speaking to the consumer rights I know we had no legality to ask for that money back, but the garage have agreed to pay of the finance (at quite a large loss to themselves) and pay us £1000 to do what we want with on the agreement that we would purchase another car from them on finance,

We knew we were pushing our luck and we also know that "our problem is with the finance company not the garage" according to our finance agreement,

Since the regional manager got involved with our case he has not been able to do enough for us and I am very great ful that he didn't make me drive around in my car knowing that I didn't feel comfortable in it any longer and didn't trust the car anymore,

We have decided to agree to the garage paying off the finance and giving us £1000 back of the £2000 we had already paid,
we have also chosen another car from them, he knocked another £1000 off that car plus got the payments as low as he possibly could,

The finance company have agreed to give us £100 in compensation for our inconvenience ,

So in the end all has ended well, for us anyway,
I do feel for the garage as they have lost out on approximately £4000 in all this mess,
i would like to get the Regional manager a thank you gift but I'm unsure what I should get him,,,,, any ideas?

                TIA

                Alls well that ends well
