Hello Beagles, I Need some advice. We Paid for a Bath (and had even altered the bathroom for it to fit), then get a call the day before delivery to say it has been sold to another customer. They have promised a re-delivery for mid November. We are now without a bath and need to put the whole job on hold. Is there any form of compensation that can be requested? Where do I stand with rights and so on. Many Thanks GB

Was this purchased on line, or from a local bathroom centre?
If purchased locally do you have a copy of the supplier's T&Cs you can post up?
You say delivery promised for mid November .... should that be October?
"the whole job is on hold"..... is the bath part of a project? diy or builders?

The old bath was ripped out with the new one expected.

No, they promised redelivery for mid November. Was meant to be delivered today. They said it had been sold to another customer and they did not have any more until November.
It is part of a whole new bathroom build - we had a wall extended to accommodate the L shaped bath. We have had to therefore cancel plumbers and tilers.

Those terms and conditions apply to on line orders.
On line orders only become contracts when they dispatch the goods.
I understand you went to their showroom to order.
Was it from a catalogue or on display?
Did you pay for it when you ordered it?
Did you get a receipt, possibly with T&Cs on the reverse?

It was bought from the store and was on display. We picked the designs with the sales assistant and paid. The T&C don't say too much other than a cancellation charge of 50% for the bath (they cancelled, not us) Refund 28days and exchange 365days.
We are looking at getting another bath from somewhere else. We may need to change the design of the bathroom slightly.

As you have decided to go elsewhere I doubt if it is worth pursuing compensation.
If you were prepared to wait till midNovember you may have managed a negotiated discount.
To try and obtain compensation for any additional costs, delays and disappointment through the courts could cost, will be stressful and IMO not worth the candle
