  • Internet Home Broadband - Refund Issue

    I am currently dealing with EE Home (previously Orange and before that Wanadoo).

    I had requested internet service provisions when I moved back to my Folks place in 2003 (leading up to divorce) via Wanadoo.

    However, I moved with my job to Loughborough in November 2003 until July 2010. My Folks sold their property back in 2005.

    I never check my bank account, but had to pull off payments I had made to my ex-wife for maintenance for the CSA.

    I noticed a payment going out each month to Orange Home for approx £24 and did not recognise the payment.

    When I reviewed my account, I tracked it back to Wanadoo from 2004, which I had been paying ever since! Hence paying over £2,700 for a service provision that I never had!

    I immediately contacted EE (who now own Orange) and discussed the situation over a month ago. Following full explanation to Olivia, (who took the call) she advised that she would pass the information onto their refund department who would make the full calculation and arrange the refund to me. She advised that she would call me every day with a status update. However, I did not hear anything and so chased twice, both times they told me that it was being reviewed for refund.

    I have received a call this afternoon from Olivia who advised that they could only refund me £200!!! I asked to speak to her manager and was put over to Daniel. He advised that I should have cancelled the service back in 2004 and that I should have checked my bank account, which would have shown that I was paying for something I did not use.

    I held my hands up and said that I should have checked my bank account though had no reason to, except to check for CSA and that I am sure that I cancelled the account in 2004, though have no record of it.

    He also said that they should have known that I was not getting a service as they had never dispatched the modem, etc to connect me to the internet. Hence I have paid for a service that I had never used and did not have the capability to connect to either.

    He then said he would increase refund to £500, which I said he had to be joking. He has now gone away to spoeak to Senior Management Team.

    Do I have a leg to stand on, seeing that they have no record of me cancelling on their system; even though they admit that they had never dispatched the modem for me to utilise the services anyway?

    Guessing they haven't come back to you yet. Sounds like they have accepted you never had the service so hopefully senior management will use some common sense - could be expensive if you managed to reclaim the money in court as there'd be some interest to add to that.

    If you don't get anywhere on the phone you'll need to put your complaint down in writing and go through their formal complaints process then you could go to ''dispute resolution'' (like FOS for comms contracts) Did you write to them (or email) when you contacted them last month or just a phone call ?

    (oh and yes, you'd only be able to get back 6 years unless it was fraud or misrep)

      I would write to them . if you can get a name so much the better , and outline the situation . Include all the conversations and the offers and the admissiion from the manager that they should have known you weren't getting a service . Just keep it simple and pilite outline your points and ask for a full refund of te money paid as you have nt used or been able to use the service

        Thanks for response Sharon, just a quick reply at this early hour as off to Essex to HQ.

        conversation via phone to date, nothing in writing, so will use the verbatims used by Daniel (Manager) who within 2 or so minutes told me they have not sent the modem and that they were partially to blame. However, still reiterating that it is down to the customer at all times. And with his submission increased refund to £500 for their partial fault.

        to me it is significant, as I could never have used their service without the equipment to connect to the service which may or may not have been provided.

        jules had mentioned the6 year rule, though with interest @ 8%, would still push it to around £2,000.

        Anyway many thanks for the input and I will write down the detail and go through their process.

          Many thanks for response too and I have outlined actions above.

          I will call to get the surnames of both Daniel and Olivia to add to the detail of my courteous mail to them, initially asking for full refund with aim to accept 6 year ruling plus interest.

            UPDATE


            Further to the information provided by Tools, Amethyst and Seduraed, I received a follow up call this morning from Dan to advise that they would meet me halfway.

            I advised that I had spoken to a Solicitor friend and that I was eligible for a full refund if I went through the courts due to the fact that I never received the hardware to connect to the Internet. This was a process that I did not want to go and based upon your information advised that I would settle for 6 years plus interest.

            I asked him to e-mail me the information and include his contact details, which was forthcoming immediately and advised that he would provide a new figure later in the day to discuss.

            I received a further e-mail this afternoon from Dan advising that 6 years payments equatedto £1,717 and that they were prepared to offer me £1,900.

            I will therefore be accepting their offer, as they are fully aware that they didnt have a leg to stand on due to not providing the hardware back in 2004.

            So, many thanks again for your advice which enabled the successful conclusion to my issue.

                Yes indeed Sharon.

                To think in 24 hours, their initial refund went from £200 to £500 to £1,300 and finally £1,900 settlement
