  • Sold faulty car from independent dealer

I'm having issues with a car I have purchased.

I bought a car from a independent dealer in Swindon ~60 days ago now. 40 minutes after I bought it, the engine seized and blew.

The garage agreed to repair the car and I arranged for it to be towed to a local garage, the replacement engine they sourced and ordered between them seems to have been faulty also (Direct Engines UK - Glasgow).

I've asked for a swap back of my part-ex or a full refund but have been refused multiple times by the original garage as they state, they've paid for the engine and it's not their fault it was faulty.

I haven't been provided with a courtesy car during this time, so have had to pay £650 in hire car charges so far.

Unsure what my options are moving forward, at this point, I just want a full refund, for them to collect their car and for myself to take my business elsewhere.

    Hi and Welcome.

Write (signed for) to garage advising them you are rejecting the vehicle as unfit for purpose and not of satisfactory quality as per your rights under Sale of Goods Act 1979.

You require a refund as they have indicated they are not prepared/cannot repair the vehicle supplied.
The vehicle supplied includes the replacement engine which is unsatisfactory.
The fact they arranged for another garage to replace the original engine with another engine does nor relieve them of the duty to ensure the replacement engine is satisfactory.
Your contract was with the original vendor.
If you accept a repair for a major fault you can still claim a refund later if the repair is not of satisfactory quality

The next step is report to trading standards (with full details)

If trading standards don't help the next step would be court.
If you get to that stage come back for further assistance.
In the meantime gather together all your evidence: bills & receipts
    letters & emails
    record of phone calls
    paper work about the contract
    witness statements

Thanks so much for a quick reply des8.

I'll get a letter drafted and sent off to them ASAP.

As it's been nearly 7 days since the garage signed for my letter requesting a refund with no reply, would you advise going through trading standards next before looking at small claims court?

Am I correct in thinking that all trading standards complaints have to go through CAB now?

I would give them a few days more..
Local Trading Standards office can be found through this site https://www.gov.uk/find-local-trading-standards-office.
Enter your postcode and you will then be given your local TS office (probably local council office)
Have a word with them, as this outfit might already be known to them
