I have a case that was due to go to hearing last month. The defendant got an adjournment the day before claiming they had not had the directions despite having three months to get them and having my court pack for 2 weeks. I'm 100% certain these are delay tactics. I am going to win, I've been certain of that from day 1.
He managed to buy himself a little over a month and now the deadline for submitting is court pack is in the next few days.
My questions:
1. if he doesn't submit his court pack by the 14 day deadline is there any way I can apply for default judgement and if so what is the best way to do that? Or is it better to wait for the hearing date and speak to the judge directly assuming the defendant doesn't turn up?
2. Does anyone know of any other delay tactics he may try again considering he got the adjournment?
