  • Appealing a Council Tax Liability Order

    Hello,
    I have received a council tax liability order and need to appeal.

    The reason for appeal is
    - I have not received the council tax bill despite telling the council to send me - 3 times
    - I was not sent a letter for intent of court proceedings
    - I was not sent a summons letter
    - not being sent a summons, hence not able to defend.

    The property was rented to a tenant who left and informed the council a wrong moving date. I told the council that the tenant was lying and sent me an email with the a different moving date and then they did not move out on the agreed date but overstayed. After leaving they did not close the utility bills and I finally got a utulity bill - a different date again - nearly 1 month after they left the property, still no keys returned.
    I told this to the council but it seems they did not believe and took me to court without giving me a chance to defend and prododuce the evidence,

    How do I go about appealing and possible set aside the judgement?
    Any help appreaciated.

    My previous council got a liability order against me without informing me too ... I had NO bills, NO reminders etc ...

    They admit sending letters and a summons to a different address, but still got the bailiffs involved. I got a 30day hold put on it while I sorted out an appeal - but they didn't send me any of the things I requested and the man I was dealing with went on holiday and his minions have passed the LO back to the rossendales in his absence!

    Grr :/
    Debt is like any other trap, easy enough to get into, but hard enough to get out of.

      There is another thread running on here very similar to this where a Tenant wants to try and set aside a Liability order from what I read its not easy to do almost impossible without incurring costs greater than the sum owed.

      Might be easier to get in touch with the Council .Beware of bailiffs becoming involved that's fees you want to avoid.
