  • Bought 2nd hand bicycle and then found seller had it advertised cheaper elsewhere!

    Hi

    I recently saw a bicycle on Ebay and it was advertised for £250 start bid.

    With one day to go it had received no bids. I went to view the bike and agreed £235 cash for it and obtained receipt from seller.

    As it is a classic handbuilt bicycle, I decided to search online to see if I could find photos of it in its original colours and then found that the same person has been trying to sell it on a cycling forum since Sept 2012 for £150. A new post to the thread in Jan 2014 states it is still for sale with no indication of price change.

    Do I have any legal rights for recompense or compensation? The seller is a private person.

    I want to call him and say I have seen this but I do not want to do this whilst I am still annoyed about it.

    Advice greatly appreciated.

    None at all, you viewed the bike and offered £235 which he accepted. The fact that he may have been willing at some point in the past to accept less, whilst annoying, is irrelevant.

        OK. Thought so but was not 100% sure.

        I suppose I can call him and express my disgust at the fact.

        I did feel slightly pressured into buying because he said 8 people were watching it.

        The other annoying thing is I went out on the next day and fell off it and had an accident and cut my hand up pretty badly which required treatment. Still not clear what caused the accident.

            The consideration was the bit of which a little more was needed. You're flogging a dead horse trying to recoup anything. I do hope you weren't badly injured.

              Sorry but my partner has just pointed something out.

              Maybe I am still flogging a dead horse with this but here goes...

              When we went to view it, my partner did ask what was the minimum that he would accept and he said £240. As we have proof that this was advertised in Sept 2012 at £150 and again in Jan 2014 without any indication of a price increase, would it not be seen as the seller was being deceitful in not telling me that he had it advertised elsewhere for only £150 because surely his intention was to accept only £150?

                No. Some things increase in value over time. You could have bartered, you agreed that price, you paid that price, you got a receipt. Job done.

                I wish you'd seen it when advertised elsewhere, but c'est la vie!

                  Not at all...
                  He can advertise it for whatever price he decides. In as many locations as he likes.
                  He is under no obligation to disclose any information to you.
                  You saw the product and agreed a price.
                  End of story.........

                    I do too. Could have done without spending £235 but my partner said it was a good buy which I think it is. Some Aende bikes have sold on Ebay for over £400 recently.

                    Oh hum! Many thanks for the prompt advice. Still gutted and will voice this when calmer to the seller to see if he takes pity!

                      They were, and remain excellent bikes. Enjoy riding - don't fall off again unless in the process of running over "accidentally" the person who sold it to you.

                        So maybe the seller realised its value and that £150 was too cheap. At £235, he got £85 more and you saved up to £165

                        Would you have done different if the roles had been reversed?

                        Be happy you both got a good deal.

                          Perhaps you will take pity on the seller and admit what a bargin you got out of the deal and offer to split the £165 saving you made with him if we are talking about disgust and deceitful actions, just saying.

                          But seriously, the buyer and seller agreed a price; they are both big boys and both could have walked away at any time if they did not like the level of money being discussed.

                            It is a bit like someone who purchases something in a shop on a Saturday and then finds it much reduced in the 'sale' on Monday. There has to be some point in time when all 'sale' items are reduced or sales would never exist and no shop could ever reduce anything.
