    Hi, I have just finished my first 2 weeks of practical at the Wolverhampton site and by the end of it we would be Prat P defined scope , the experience was very good up to the last couple of days. We were advised by the tutor, who was very good may I add, that due to Trade Gateway booking in to many students to the classes that we may not be finished by the end of the 2 weeks...... which we didn't.

    I sat my exam and passed it as well as all the practical test given to us, but come Friday afternoon we were told were would not have enough time to complete the 2 weeks and would have to try to come back in at some other time down the line. This didn't go down very well with all the guys in the class as you can imagine as some have no holidays from work left and would have to take un paid days off, not good and not fair I'm sure you will agree.

    We are under the impression that the exam and test we sat and passed have a limited time frame on them if we don't completed the 2 weeks and get it signed off, which we didn't have time to do. Upon asking when we could come back in there was no really answer other than that they have a mop up week in October to get everyone through......which is fully booked up of cause!

    So when we all left on Friday we were all none the wiser and have nothing to show for the 2 weeks we did and the exams and tests we sat as they kept all paperwork. Even as I type this I really don't know where I stand, no certificate, no signed paperwork to say we have done it, nothing.

    I have sent a email to Trade Gateways about the situation but as it's a bank holiday I they won't even see it til Tuesday. Everyone is worried that because we couldn't finish due to them booking to many students in each class, an on going problem we were told, that all our exams and test will be null and void by the time we can get back in to hopefully finish, if they even let us, due to them not being able to book us in any time soon. Also there is a slight concern of paperwork going missing as this happened to one student and he had to resit the whole 2 weeks again.

    I kind feel lost at this moment as what to do and feel like I just wasted 2 weeks and a lot of money. I'm happy to continue with the course but am not willing to resit the first 2 weeks if everything is lost or voided.

    Any advice you can give to help me throw their way when they hopefully contact me would be ideal

    In post 147 you said the course was mis- sold
    In post 154 you said the course was mis represented
    in post 161 you said it wasn't what was set out originally when we signed.


    A misrepresentation is a false statement of fact (not opinion or estimate of future events) which induces a party to enter into a contract.
    The remedy for misrepresentation is rescission &/or damages
    Misrepresentation Act 1967

    Can you explain fully how you believe the course was misrepresented because if it was misrepresented, IMO you should rescind the contract due to that misrepresentation.
    This would have the effect of putting you back in the position you were before signing up i.e. return of all fees and Trades Gateway sorting the finance.

    BUT YOU WILL HAVE TO PROVE MISREPRESENTATION

    Do you have the previous letter you sent them and their response ? Could you post them up and we can help sort out a formal complaint in response, which we can CC to Caledonian Finance as well.
    The etter basically set out that we wish to cancel the course with immediate effect, it wasn't until we read into the terms and conditions and also the qualifications that it offered that we realised it wasn't what was set out originally when we signed. No one as yet has completed the course.

    Tradesgateway initially - and keep up payments with calendonian in order to prevent damage to your credit file - they are (supposedly) a third party and your argument is with TG for the moment.

    So should I raise the complaint formally with trades gateway and Caledonian consumer finance or just trades gateway?

    You should raise a formal complaint with a view to taking it to the financial ombudsman. The course was not as represented to you and the lender is jointly liable under section 75 consumer credit act.

    I'm not sure, my credit rating has gone from 5/5 to 3/5... I've just rang and paid the remaining payments.. Think I'm just going to have to carry on paying!

    You mentioned a CCJ on your credit file ? Is there actually one on there and does it state who bought the claim ? If there's a CCJ in place for this you will need to take different action to if you have just cancelled your course and started to deal with the finance company.

    No, we've not paid the direct debit for 2 months now, we emailed and wrote to Trades Gateway to cancel the course but they were very unhelpful and just said they are sorry to hear we've cancelled, the course was misrepresented but now struggling to get trades gateway to return the money to Caledonian consumer finance and they have been sending a lot of letters.

    If you didn't stop paying the direct debit until the end of May it is unlikely you will have a CCJ registered against you already. They'd have to issue the claim, wait at least 17 days to get a default judgment, then a CCJ isn't registered for 28 days after that.

    Hi Kati, I've been checking my noodle but it doesn't even show up the finance on there even though other finance I have is on there, there are now CCJ's against me.
