    Not necessarily. There is an exemption for certain types of instalment credit, where the credit is provided without interest or other charges (such as an administration fee) and is repayable within 12 months by no more than 12 payments.

    okay that makes sense. Did LHH have any input into your choice of course at all ?
    They had to talk to my previous employer as TG were not on their list of preferred (which I presume were more legit and reliable) course providers. But there was no issue as far as I know.

    Yes we tend to include it straight off, and change the wording of the letter to say ' I enclose a cheque/postal order for £10 which is the maximum statutory fee.' but it isn't compulsory to do so if you don't have it spare right now.

    It was £2000, split £500 to LHH for advice, consultation, help writing CV's and £1500 towards retraining on a course of our choice.
    okay that makes sense. Did LHH have any input into your choice of course at all ?

    Send a £10 cheque or postal order (payable to them) marked "for statutory fee only" with the SAR ... that way they won't be able to say they can't do it until they get the fee

    They'll have 40 days to comply

    This SAR appears to be a great next step, thanks. Do I submit the SAR and await them replying asking for a fee?

    SAR = me being lazy, subject access request under the data protection act xx That should bring up any communications between TG and LHH about you and your account. Be interesting to see how TG represented the course cost to LHH.

    Was it a matter of a £1500 allowed from your redundancy for retraining? ( just as to why it was £1500 that was paid)

    This is where it gets a bit awkward, my former employer instructed a 3rd party, LHH associates (Lee Hecht Harrison I think) to handle the funds to help the people that were made redundant. They helped with CV writing etc. So when I was chasing this £1500 to be paid it was LHH I was in dialogue with. They in turn were in dialogue with Trades Gateway and then sent me a copy of the paid invoice when it was paid.

    Probably a SAR to Tradesgateway as well in that case.

    Will mean shelling out around £22 overall.

    SAR to Tradesgateway and CF4TS
    CCA to CF4TS and ARC.

    And if you can dig out any paperwork you do have it would be very useful.

    Presumably your employer saw the documentation when agreeing to pay the £1500 to TG ?

    I haven't heard from DRS since I got notification that ARC Europe were taking it over. I will wait until ARC call me, i'll speak to them and see what they say

    DRS could be in trouble if they tried collecting anything when they are not involved (ARC Europe have been passed it by CF4TS so it's no longer anything to do with DRS ) ... that being said, you could always write (or email) ARC and inform them the debt is being disputed and request that they cease collection activity while the dispute is on-going.

    yesterday I was with the owner of a Heating and plumbing company and a guy who paid 3 grand for a course like these he says he was unable to complete it and the business owner said they would never employ someone who got one of these course completed and did not have a few years of experience

    Nope the DPA and the CCA should go to CF4TS.

    IF they have sold the debt to ARC then you could send a CCA request to ARC as well, but the DPA request should go to CF4TS.

    Did your employer pay CF4TS directly or did he pay Marlborough/TradesGateway etc ?

    Presumably your employer has accounts and records of payments made so should be straightforward to evidence that payment was made if need be.

    How much was the course originally ?
