    Hi all I am new to this and am I need of some advise

    In 2008 I bought a car using welcome for the hire purchase, in september 2010 I contacted them and asked them to come and collect the car as I wanted to voluntary terminate the agreement as it said I could in the agreement (already paid more than 50o/o ) they tried to get out of it but finally took the car in November 2010.

    In January 2011 I got a letter from them saying I owe them 3655, 4000 left on agreement minus money they got selling the car.

    I wrote to them saying I didn't owe anything as car was voluntary terminated.

    They then wrote back and said it was voluntary surrendered and I had to pay up.

    Obviously I didn't

    Now my wife and I want to buy our first home and can't get a mortgage because welcome put a default on credit file in December 2010.

    Default was record before I received first letter with supposed outstanding balance and was not sent default notice, I have read that default notice has to be sent 28 days prior to default being recorded.

    Need this default off of my file any ideas anyone

    You need to understand the difference between voluntary termination and voluntary surrender, the former as you say entitles you to return the car at no extra cost, the later may not, the sums outstanding can be calculated using the value of the car.

    so in future correspondence you need to refer to this as a VT not a VS.

    did you notify them of your intention to VT in writing, do you have any record ?

      i still have all correspondence with them since the day I bought the car, I do realise there is a difference between VT and VS and did make sure that I clearly state that I wished to VT the agreement, they only started on about VS two months after they had the car back

        OK you need to remind them if you haven't already.

        You terminated under section 99 of the consumer credit act on xx/xx/xxxx, There were no sums outstanding under the agreement at this time, therefore any negative markers placed by you on my credit record are incorrect and must be removed immediately, failure to do so will result in compliment being made to the FCA and the ICO and may result in an action for damages under section 13 of the DPA 1998.

        that sort of thing.

          Ok, thanks for that will write up a letter and get it sent, will let you know what response I get
