  • 2nd hand goods but still under 12 month Man guarantee

    Hiya folks

    Hopefully a quick one.

I've had a search and can't seem to find anything and google hasn't answered my question either.

If I buy something 2nd hand but its still under the original 12 months manufacturers guarantee do they have to honor if it goes faulty.

If I bought a Tv and the salesman says the TV come with a 12 month Guarantee. Then surely its the TV that has the guarantee NOT the original purchaser

Manufactures warranty is only valid if you have receipt proving date of original purchase. Whether they would cover second goods sold on whilst still under their 12 month warranty, would i expect be at their discretion. Though if the original receipt does not contain the original customers name and details, then i doubt they would question you about it. You would have to contact the manufacturer directly giving the original purchase date that the original owner made the purchase on, you make a claim under manufacturers warranty. And not take it back to the shop it was purchased from.

A gaurantee offered by a TV sales man, would be a Guarantee under the contract of sales between you and the seller only, and nothing to do with the manufacturer. In such circumstances you would have to be the original purchaser, since the seller would likely have taken the original buyers details.

I thought all electrical goods sold had to have a minimum of a 12 month manufacturers guarantee.

Yes they do, but only when they are sold as brand new goods by authorised sellers/stores and not by private sellers selling 2nd hand used goods.

Such law does not apply to second hand goods, so it would be up to the manufacturer if they honored the warranty when the goods were sold to on to a 2nd hand buyer. Their may even be a term or clause in the manufacturers warranty that comes with the goods inside the original packaging stating that the warranty is voided upon the resale of the item!
