    All,

    Can I please request some assistance in regards to booking and delivery charges from Eventim for the Haye Vs Fury boxing event that was cancelled twice.

    Eventim were charging a booking fee per ticket at a percentage of the ticket price at roughly 10% of the ticket purchase price.

    I bought X 2 £125.00 tickets and paid X 2 £12.50 per ticket as a booking charge plus delivery of £7.50.

    Tickets were purchased 11th July 2013 and the event was cancelled twice and Eventim only refunded me £250.00.

    Now terms and conditions might cover them for this but does the law? As far as I can see my contract was with Eventim and purchase made was under the sale of goods act, to which Eventim have failed to deliver what they promised and charged me for the privilege of effectively holding my money from 11th July 2013 and delivering tickets for an event that never happened.

    I have been in contact with Eventim as it appears that they have been refunding some customers ticket processing fee's and delivery charges but not others:

    However they will not refund mine or offer any explanation why some customers have been refunded and not others.

    I have read somthing about Unfair Contract Terms Act The Unfair Contract Terms Act 1977 and the Unfair Terms in Consumer Contract Regulations 1999 but have little knowlege on it.

    Bearing in mind that 10,000 tickets were sold for this event and the majority of customers have not been refunded these charges. Now Eventim have said that these charges cover processing costs/time, investment, to which I have zero interest in and can not see why these charges are a percentage of a ticket rather than a standard charge. It should cost the same to process a £40 ticket as it does a £1200 ticket in my option.

    Can anyone shed any light on how I should proceed? I piad via credit card luckily but not sure what time would be best appropriate to get them involved.

    It depends on the T&C of individual ticket sellers.

    Some refund postage costs only, some refund fees, most don't

    Eventim T&C's state they will not refund postage or booking fees.

      Even though they cancelled and not the OP? How can that be a fair T&C? They could make a fortune that way for providing no service at all, just messing people about :mmph:!

      Would that really not be classed as an unfair contract in law??

        I appreciate that, however Eventim FAQ on booking charges:

        "The booking fee charged per ticket pays for the technology infrastructure, distribution network, credit/debit card processing services, merchant fees, telephone lines, labour and other costs associated with arranging and managing ticket inventory and servicing a ticket transaction. The fees we charge are negotiated and agreed with promoters and venues for each event, and the level of fees and presentation is therefore often different for each event"


        Now I and many others appear to have paid to help build an 'infrastructure' for Eventim through these fee's for an event that they could not supply, let alone hold my money in the mean time, this does not sound right at all.

          P.S I have be sending a few tweets about on this and posted some links on a couple of forums, around 10,000 people would have been affected.

            10,000 x £12.50 should help build a lucrative infrastructure for doing diddly squat.

                I shall be issuing a charge back shortly but I don't see why they should get away with this so looking to take further if possible.

                Please note, ticket prices were from around £40 into the thousands for ring side seats all with a 'booking fee' PER Ticket at a percentage of the ticket face price so a pretty penny was made.

                Is there a way to find out who the shareholders are in Eventim UK and its subsidiaries?

                  1Making the arrangement legally binding on you, but not on the supplier.

                  2Allowing the supplier to retain money in the event that you cancel, but not obliging the supplier to pay compensation in the event that they cancel.

                  4The requirement for you to pay cancellation charges which are disproportionately high.

                  Examples of what is considered unfair - there are more listed but the above seem relevant here.

                      The "infrastructure" for which you pay, is of course for your benefit.

                      "We enable customers to buy tickets seven days a week and twenty-four hours a day without the need to spend time and money on travelling to the box office to buy tickets."

                      Now you can't expect service like that for free, can you?
