Hi. I'm new to these forums as I am really struggling to break new ground with my issue.
On 23rd September 2012, I purchased an iPhone 5 64GB phone whilst buying out my existing contract with Orange and starting a new 24 month contract with Orange at Carphone Warehouse at the Strand next to Trafalgar Square.
2 Weeks outside of my limited manufacturers warranty the phone has developed two faults. The Power button does not work and the battery has failed. (Both diagnosis's have been made by Apple).
Apple are saying that after the 1 year limited manufacturers warranty I must contact the original retailer of the iPhone if I wish to claim under the SOG act.
Carphone Warehouse have stated to me that if I had reported the fault within 6 months they would have carried out a repair. My problem is that the fault didn't exist in that time period.
I expect to still be covered either under SOG or under European Directive 1999/44/EC:
'A two-year guarantee applies for the sale of all consumer goods everywhere in the EU. In some countries, this may be more, and some manufacturers also choose to offer a longer warranty period.'
Carphone Warehouse have told me that they are not governed by Directive 1999/44/EC and that I must pay for repairs even though the phone has been used in a normal way. I would expect the phone to still be fit for purpose (SOG 6 years?). I would also expect the phone to last longer than a shade over 12 months considering I have a 24 month contract.
Can anyone please help me. I have written to Carphone Warehouse, I have had numerous phone calls and yet I am getting nowhere and they have proven to be unwilling to help.
