I upgraded my phone with Three last week to Iphone 5s they said I’ll receive it by Monday 30th Sep. the delivery company is DPS. On the 30th Sep morning I received a text from DPS stating I’ll receive my phone between 14:00 – 15:00. I was not going to be home around that time so I decided to change my delivery date to the following day which they accepted.
At 15:00 I received a text from them stating that they have delivered my phone to my neighbour(stating his name and house no) and that he has signed for it, the same evening I went to his place and he told me that he was home around that time and nobody delivered anything.
In past at times when I’m not at home my stuff is usually delivered at his place and I have always received it however those were clothes from high street which costs no more than £50 and this is Iphone 5s(£549).
I call up the customer care and they said to give them 48hours and they’ll investigate with the courier company and get back to me. They didn’t get back and I had to call them after 48 hours, when I did they said your message was delivered quite late to the courier company and it never reached the driver hence they delivered it to the neighbor. I informed them that my neighbour claims to have not received it so now they’re again investigating it and have asked for 48 hours again. I feel really frustrated as I have paid for an upgrade and I don’t have a phone, it’s been four days since and they are neither willing to cancel my contract or give me another phone but have charged me for the upgrade. All they are saying is the delivery company is investigating it and haven’t given me any time frame or an outcome. I don’t know how to go about it as I’m going on a long holiday end of next week and I really wanted my phone before that.
Can somebody please give me any advice(ideally legal) on how can I go about it?
