    Hello , firstly apologies if this is posted in the wrong place. I usually do.

    Secondly many thanks for a great site, I have gain a great deal of knowledge from reading the posts and replies.

    Here is my question.

    Seven years ago my (now) wife accrued a debt with her previous partner. He since left the district and at one point was abroad but now back in the UK. We had paid over half of the debt and have asked the council to try an pursue the other liable party as well. They have not done so, and this has resulted in Ross&Roberts rocking up (with no notice) to clamp her car etc. Any way I digress.

    So my back to my question: Is there any case or precident I can refer to that would force the council to actually pursue "both" parties rather than just one. We/she is not denying the debt of course but wants to feel less discriminated against.

    I am not 100% sure, but as the debt was a joint liability, I believe that they can choose to pursue one or both of the liable parties. :beagle:

      You are absolutely correct, LM. It is joint and several liability if both persons' names appear on the CT account.
