After consulting the manufacturers website and referring to a brochure given to us by the dealer, we ordered a brand new car in July to our specification (the first time we have ever been in a position to do this) and we collected it at the end of September.
The day after collection one of my kids said mum you said we would have electric windows in the back and we haven't.
I phoned the dealer who blamed the manufacturer. The manufacturer says it was up to the dealer to tell us that there had been a change in the specification of the model we orderded and that in the small print it says that the manufacturer may change specifications at any time.
The manufacturers website was still stating 12 days after we took delivery that our model came with electric rear windows and I have a printed copy of this and a screen shot of the web page as proof.
I am now going to send a letter recorded delivery to the dealer asking them to put it right under the Sale of Goods Act 1979.
Some people may think I am being petty when it is just electric windows but when you get all excited about having ordered a car with what you want and look forward to it being built and then delivered, it kind of takes the skin off the top of the excitement. Instead of enjoying our first brand new car I am having to argue for what I ordered. I am getting a bit p****d off at people being mugged off.
The issue I have is what do I do about the finance company also as the agreement is a Conditional Sale agreement and as far as we are concerned we did not receive the goods we ordered.
Does anyone have any further advice as to what we can do.
