  • Sale of Goods Act - Fit For Purpose.

In September 2008 I purchased a 4 in 1 Epsom printer. This developed a fault in May 2009 and was replaced by Staples with an identical new machine.

This printer which was little used (only 1 black cartridge changed logged on the machine) developed an unrepairable fault in September 2009 therefore it was only 4 months' old.

I had a Staples Warranty which replaced this machine, but this time not with an identical Epson, but with a 3 in 1 HP Printer, stating that because I had only paid £99 (special offer) for the original printer I could only get a printer of equal price. The Epson was £157.

I was not happy with this and asked Epson to replace their faulty 4 month old product under the SOGA as in my opinion it was not fit for purpose - I had taken the 2nd printer to an Epson dealership who confirmed it could not be repaired and should be replaced by Staples.

On both occasions when I wrote (Recorded Delivery) to Epson, I was ignored until I e-mailed and requested a response.

Their response was that as the 2nd machine was 'out of warranty' nothing could be done, however, the 2nd machine was only 4 months' old, but they said that did not matter as their 'warranty' under SOGA runs from the date of the purchase of the 1st machine, and not the date it was replaced.!!

Is this correct, or is there anything more I can do. I hate HP Printers, and am not happy with the replacement at all.

Staples let me keep the malfunctioning 2nd Epson, so I still have proof of dates as Epson printer have iternalized useage information.
