  • Faulty PS3 complaint resolved

    I purchased for my son a PS3 with 3 games in April 2008, in November 2009 the PS3 froze and after ringing Sony help line and my son going over what had actually happened the young man at Sony said it was no doubt the lazer that had broken. They were quite willing to repair the PS3 for £99 or send him a reconditioned model for £125 both with a 3 month warranty.
    I did a bit of research about this and found it was widespread and even Watchdog had covered the problem on TV. Lots of people had been lucky and the fault had shown up within the manufacturers 12 month warranty period and so had got replacements. Others had paid for repairs and the fault happened again, infact you could read for weeks on different forums and all with different outcomes to this problem.
    I really didn't know a lot about the SOGA (Sale of Goods Act) so I asked a man who did
    I started off by phoning the retailer (a well known catalogue company) for information about my actual purchase date and informing them of the fault.
    I was fobbed off basically and passed from pillar to post re the information I had asked for.
    By February I got as far as them saying I had to have an independant report done and take legal advice.
    This I replied to with a LBA (letter before action) and as they didn't respond to thisI issued court proceedings in the Small Claims Court.
    That was followed by mediation (something the Judge had recommended) and as the retailer was adamant that £99 repair was all I was getting initially I eventually got him to make an offer of £200 that was to include all my costs.
    I again refused as I didn't want a repair my intention was to get a new PS3.
    So stalemate and I had to get the court papers in by 4 the next day which I did, though I say so myself I made a very good job of the bundle too.
    So the next day an email pops up with the offer of a new PS3, now why he couldn't have said that at the mediation and saved me all that printing I have no idea. I accepted but asked for a little bit more due to my running around like a blue arse fly the day before, so another £20 was offered which I also accepted. Both have arrived safely.
    So in the end I got there, but have to say with a lot of help from Cetelco and a shove from Amy lol

    Well done you.... and a little shove from me as well to get the extra money. As I said if you don't ask you don't get.

          What is nice is that you actually saw it through to the end. A lot of people start things like this because they feel hard done by and rightly so, but far more fall at the first hurdle.
