  • Cineworld Unlimited Card T&C's

    Recently I subscribed to an Unlimited Card with Cineworld. £12 to watch a film when ever you want.
    Last week I found out that Cineworld will no longer validate parking in the complex it is based.
    This means it is no longer worth subscribing to the card, as it would cost less to go to another cinema with free parking.
    I am under a 12 month contract, but now want to get out of it, is there any way?

    I would think 7.2 would be the clause.

    A Warm welcome to the forum. Where is the clause about parking?

    In fact I think clause 13 is their get out clause

    "13. FORCE MAJEURE

    We shall not be liable to you by reason of any failure or delay in performing any of our obligations under the Conditions if the failure or delay was due to any cause beyond our reasonable control."

      11.4 We shall not be liable to you or the Payer in respect of any indirect or consequential loss, damage, costs or expenses or other claims for consequential compensation whatsoever which arise out of or in connection with the Unlimited Card.

      I would think the car parking is a consequential expense.
      Cineworld are under no obligation to validate the parking under the terms of the card.


      There is also this
      11.3 We shall in no circumstances be liable if one or several Cineworld cinemas are closed permanently or temporarily, for whatever reason or if a particular film is not available for whatever reason.

      7.2 has to be in conjunction with 7.1 and as the parking was not a part of the contract it is irrelevant.

        Having had a quick look at the terms, it seems that cineworld holds a right to terminate (clause 9.5) "at any time for any reason" - is it not an unfair contract term if the consumer is not allowed the same right of termination?

        Obviously for fairness, this right of termination would be under the same conditions - ie a month's notice - but I imagine that would be fine with you, to avoid paying for the full 12 months of the contract.

        I would be grateful if someone who knows more about unfair contract terms for consumer contracts had any thoughts on my suggestion.
