  • Debt Collection -- Statute of Limitations

    I received a letter from a debt collector named Transworld Systems Inc. The letter offered many payment plans to settle the alleged debt they were referring to. They were demanding by August 27, 2024, that I'd have to make a payment plan. Keep in mind that I live in Tennessee, and the SOL of debt is six years. If I remember carefully, the last time I made a payment to the creditor was August 27, 2018, where the 27th this year in August 2024, which by the way landed accurately with exactly six years from when I made my last payment.

    Transworld said that they're not obligated to offer one of those options unless it was before August 27, 2024. Since the SOL (Statute of Limitations) on this debt expires very finitely (August 27, 2024), and I wanted to send a cease and desist letter to the debt collector, would it be detrimental if I sent the cease and desist letter after the Statute of Limitations? What if I sent the cease and desist letter before the SOL? Would it re-start the Statute of Limitations?

    What about a Cease & Desist letter before SOL? Would it hurt?
