  • Premium or standard delivery refund

    I recently bought an item from an online store and paid extra for next day delivery.
    The wrong item was delivered the next day and the store wanted a photo before they would email a returns label.
    As the store could not send a replacement for 3 weeks I asked for a refund. They agreed to this but are refusing to refund the delivery charge I paid, only for standard delivery.
    Is this right? It doesn't seem fair.

    If you are returning goods due to breach of contract (wrong item supplied) then there is nothing in the CRA that allows the retailer to refuse to refund any part of the delivery costs.

    (9)The consumer’s entitlement to receive a refund works as follows.
    (10)To the extent that the consumer paid money under the contract, the consumer is entitled to receive back the same amount of money.

      Tesla is right, if the goods delivered were faulty or not as described you are entitled to a refund in full including the premium. However if you are cancelling for convenience because you no longer want the item i.e. you cancel under distance selling rules then you are only entitled to a refund of the basic delivery charge unless the premium charge was the only option available.
