    Hello

    I was shopping a few days ago and I experienced a very concerning encounter with a member of staff in a shop. I've requested a copy of any audio record from this encounter. The shop has claimed that the CCTV doesn't record audio. Is there any request I can make to them to prove that there cctv doesn't record audio?

    Did they treat your request as a Subject Access Request [SAR] under data protection law? If so, and if you have reason to believe what they have told you is not true, you could com,plain to theInformation Commissioner's Office [ICO] and ultimately to the courts.But what reason do you have for believing it is not true? In an ICO complaint you would need to make your case for why you believe they gave you an untrue answer. You can't just demand they prove everything they say.

    Some CCTV cameras can record audio, some can't. But even where it can it doesn't mean shops will have the audio permanenently turned on all day in its sales floors recording the conversations of members of the public. So their answer isn't inherently unlikely.

    I would concentrate on using their complaints policy to complain about their staff member.

      It might be an idea to 'elaborate' on it, give the matter some context.

      Maybe complain to their Head Office if it's serious.
