Lesson don't trust dealers, (although you already know that), I would take pictures of all parts of the car, type up a letter in fact two, and hand one to the driver stating he has inspected the car for any sign of damage and agrees to the car as/is, he keeps a copy and he signs your copy in case there is damage and they claim it was damaged by you.

Thank you both I get something typed up for the delivery company to sign, as mentioned I will get plenty of photos on the morning before it goes, as it will be a delivery driver I’m not sure they will know the condition it was in when they sold it to me, it does have the odd age related mark that was also the case when I bought it. Do I wait for the refund before making the relevant change on the log book? Thanks again

I would change registered keeper immediately.
Give the delivery man the appropriate part of the V5C, and complete the other part and send off.
It will give you protection if the trader (or his boys) "road test" the vehicle and commit an offence picked up on ANPR camera.

Just an update the car was collected last Thursday by the trader himself on the back of a trailer, it has gone back and he said his garage will check it prior to my refund. is there a reasonable amount of time i should give him before chasing him for the refund?
