Hello everyone,
I hope someone can help me! So I was about to purchase a car from a private showroom. The car had extensive internal damage but the agent said that he can have it repaired for me to a high quality - mentioned that it wouldn't be factory quality but it would be to a very high standard. I put a deposit down on the car on the basis it was reserved for me, however I could have my deposit returned if I am unhappy with the interior repairs.
I went to see the car on a Saturday - they told me to come and see the car on Tuesday. Then they called and told me Thursday. I then said that I could not make Thursday and the next time I am free is Saturday. When I saw the car on Saturday, I was very unhappy with the interior work, it was absolutely terrible and messy. I shared my thoughts with him and he agreed to return my deposit - he took my card details etc and told me I would have it returned on the Monday.
Monday I received an email from him to say that he will not be returning my deposit due to the car being off the market for a week and that he had the car repaired as we discussed.
I am pretty sure legally that I am entitled to a refund due to unsatisfactory quality and his verbal promise of returning my deposit monies if I am not happy with the repairs! However just don't know the exact law/principle to back this.
