I ordered a refurbished TV from an well known online retailer that was advertised as grade A1 condition. (Light cosmetic imperfections) It arrived and had a line down the screen which indicated a faulty panel.
I contacted the company and arranged for a like for like replacement which was also advertised as a grade A1.
After promising to deliver the replacement on specific dates and failing to, I decided to request a refund. To my surprise and despite the retailer confirming the order had been refunded and cancelled I received the replacement TV yesterday and the refund today. Out of curiosity I unpackaged the replacement TV and it is missing the stand, a remote and has a label on the TV stating it is of grade A2 standard (noticeable scuffs and dents) TV. This obviously isn't the replacement which was agreed upon.
I contacted them to inform them of the issue and they are demanding payment immediately for the cost of the original grade A1 TV. I agreed to accept the TV but on the basis of a discount to which they replied they will not consider until the amount is re-payed in full.
How do I go about this? Am I legally obliged to repay them the full amount or should I pay them less and tell them to deal with it? Would the company be able to take legal action if I kept the TV and refused to pay? (as compensation for the poor customer service, inconvenience and loss of earnings for staying work for two days when they promised delivery)
