I am looking to take legal action against Ladbrokes for refusing to pay out winnings from 10 months ago. But I’m unaware of the best procedure.
I was self excluded from Ladbrokes a year prior to signing up again in September 2020. (I have a medical impairment that causes severe memory problems, so I had forgotten I even self excluded)
However Ladbrokes let me sign up, deposit £300 and play. I won £4200, processed a withdraw which they cancelled and sent me £300.
They told me they are only liable to send me back my deposited funds and they aren’t obligated to send me my winnings. After several back and forth, I gave up due to my health.
Last week someone reminded me and I decided to go on Ladbrokes live chat and enquire as to what my balance was on my now closed account. They said £4200 and told me they was going to process a withdraw. Again, they sent me £300 today and told me they aren’t obligated to give me anything other than my deposit.
I do not believe this is the case, given this is taken from their own terms and conditions
“15.7.10 Subject to our rights under any terms and conditions you have agreed with us permitting us to withhold any funds from your online accounts, the full balance of your online accounts will be returned to you within 10 working days via the current active payment method linked to your online accounts (albeit please note that in circumstances where you have any outstanding bets in place at that point at which your self-exclusion takes effect on our operating systems, due to the outcome not yet being determined, any potential returns due from these bets will be returned within 10 working days of the outcome being decided”
Im getting nowhere with them despite telling them I’m taking them to court. I have spoken to a solicitor who said given it’s now £3900 they owe me that the legal fees will out do the amount claiming for. I am considering small claims court, is this the road to go down? If so, how do I locate their address? Many gambling companies operate in Gibraltar. I’m struggling to find the correct address.
do I have to do anything before proceeding to small claims court?
Should i instead find a cheaper lawyer and ask them to send a letter?
I believe I have a strong case here, if you think otherwise I’m open to listening.
