    Good morning,

    My neighbour is building an extension and instead of an independent wall, has built a wall on the main building party wall. They have done this to take my legal tile easement of 30 years. Building regs application in 89.

    Their PW surveyor kept saying PWA wins over easement, is this true when it is 30 years old

    They haven't finished the build yet, but they've left a 30cm void below the paving between the walls. I'm hoping building control will have to pull it down but they've already but my tiles and built up and on my land.

    As it stands, what is my legal position now as they have stolen my legal right by fraudulent means? It's bad with the dodgy builder and she is a police officer!
    It's not been my year.

    Their planned independent wall is now a Party Wall with rights and mine have been taken away from me. Who do I need to speak to? I'm seeing a solicitor next week and hopefully their private building control surveyor will not pass it and make them take it down.

    I dissented the excavation notice so we had PW surveyors but theirs is obviously a crook and mine just signed. I've been in a whirlwind not knowing what they are covering up.
