I just want to clarify some potential confusion regarding EU Directive 1999/44/EU.
i understand and after speaking to EU citizens advice ECAS the above law gives all EU users a 2 year warranty on goods purchased so if it breaks down its repaired, replaced or refunded in full.
I am a UK citizen and purchased currys own brand washing machine with no extra warranty cover in aug 2019 when we were still part of the EU.
It broke down at 18months old.
We had to request an engineer to examine the machine as Currys would not send out anyone.
They advised unrepairable due to cost involved and it was a motherboard issue to do with the programming and not linked to the error code showing on the machine.
Error code advised pump and filter issue but when examined this was not the case.
We were advised this fault would have been there from the beginning and due to cost involved and price of parts its unrepairable.
I am not being offered a full refund or like for like but instead a small refund of £260 when the machine cost £350.
Am i entitlted to a full refund under EU Directive 1999/44/EU as this was purchased when we were still part of the EU as citizens advice have not heard of this before and are unable to advise on this?
What are my rights in this instance and if i took them to small claims court would i have a case?
