  • Bought car. Gearbox issue

    I bought a 2012 diesel astra 6 weeks ago from a car dealer. 53000 on the clock. I've done bout 700 miles.
    I noticed a noise from the engine which I too to a garage. They sent me to a gearbox specialist who have said the bearings need replacing. As part of this work the garage says should change clutch and flywheel. Total cost approx 1500.
    The dealer has now asked me to take the car to him for him to get a second opinion, however he is saying he wont cover the clutch and only the gearbox if his mechanic agrees is faulty.
    Where do I stand legally on this?

    He has to prove the gearbox was not faulty when you bought it. The clutch is a different matter. If it is just convenience because the gearbox would be out then no he wouldn't be paying, unless it is faulty.

    Did you report the fault within the first 30 days? This gives you the option of rejecting immediately.

      I informed him on 33 days. So just out of the 30 day limit.
      To be honest if he has the gearbox reconditioned I'm actually willing to pay for the parts for clutch and flywheel as the labour would be included anyway in the gearbox repair.
      I dont want to say this to the garage yet as I'm not convinced he will repair he gearbox.
      The bearings are noisy which indicates failure however I get the impression he may say they only noisy and not seized to not have to pay for the work.
      I'm very worried about this as the car was 3500 and I cant be left without it due to work.
