  • Gym Membership - Proceed to Small Claims Court?

    Only of recent I noticed that money has continually (monthly) been taken from my account by a gym.. which had been going on since November 2018 without my knowledge or approval.

    The staff reception member had signed me up for a gym membership, rather than the one day pass in which I intended on using. When passing over my details for what I assumed was a day pass, the reception staff member misspelt my email (9 instead of a q) which resulted in myself having no further contact with the gym since the initial day.

    They’ve been charging me £63 per month, since the 29th of November 2018. The company is being very rude and are avoiding all means of liability to help solve the situation. Many follow up emails have been sent but they seem to avoid all contact, and leave the non-replied emails as long as possible. I'm in contact with the CEO, but now no longer receiving replies.

    To clarify.. card information was provided, and not myself handing over the card. My details were given verbally. I feel very mislead, and done wrong in this situation.


    The question is, do i have a leg to stand on in the small claims court? - The total they owe me is 1,111GBP; I believe the court fees and lawyer may cost a 400-500GBP..

    Small claims court you can handle yourself, court fees are £70 which you claim back.
