  • TV delivered by mistake

    Am at a loss as to what I actually need to do regarding this now and am hoping someone can help.

    Basically I bought a TV online back in March. It was delivered to me faulty and I received a refund but the TV wasn't picked up until a few weeks ago. Trouble is, they not only picked up the faulty TV but delivered a new one.

    I've had this new TV now sat in a box in my house for 3 weeks. I've contacted the place I purchased it from saying they needed to pick it up but they won't because they are saying the cannot pick it up during the hours I've requested.

    Basically as a key worker i can only be home for pickups after 5pm in the week or anytime at the weekends and I've told them this but they flat out refuse to budge saying I either need to take time off work, have someone else in the house or deliver the TV back to a nearest branch (it's a 75 inch TV!)

    I have initially refused to take it to a shop as if it gets damaged in transit I believe I'd be liable for it which isn't fair because I shouldn't even have this TV.

    It's taking up a lot of space as you can imagine but I don't know where I go with this. I'm basically additional warehouse space for a company, holding on to their goods whilst they decide if and when they can be bothered to collect their goods. What should I do here?

    So write signed for to the shop telling them you are an involuntary bailee as unordered goods have been delivered to you.
    You are under no obligation to return them
    It is for the owner to collect them at YOUR convenience.
    If they do not make arrangements to collect them within the next two weeks by dd/mm/yy you will dispose of the goods by public auction, retaining the proceeds less your expenses for their collection
    Also quote to them that this is in accordance with The Torts (Interference with Goods) Act 1977.
