  • Insurance Negligence

I am sure that we a course of action against our insurer but want to double check. I'll try to be as brief as possible.

I was in the process of checking my credit score when i noticed a CCJ against my name. The CCJ had been satisfied by someone. The claim CCJ relates to a car accident I between my neighbour where I reversed into their car. Our insurance companies were notified and as far as I was aware all had been dealt with. We moved not long after this incident to a new house.

Fast forward to present, I have now found out the full story from the solicitors on the other side. As far as i can gather, directline our insurer refused to pay out on the depreciation of the vehicle that I crashed into. The other side then issued proceedings against myself, however, this was never received as it was sent to my previous address. Our insurer, directline, appointed a firm to represent me and the CCJ was satifised by directline.

My issue is that how can our insurance company allow it have gotten to this without being negligent? We have had to taken a mortgage at a higher interest rate because of this CCJ on file and our loss there is already £15,000.

I believe we have a course of action in negligence against directline. I'd appreciate any advice/help/information on the matter.
