  • Company with ongoing contract subject to a winding up petition

    I have a contract with a company (let's call them "Acme Services Ltd") that I have already paid for in full but still includes about £800 of home maintenance as part of the consideration for the contract (a £100 job annually for the next 8 years) that has not yet been completed.

    I've just learned that a Petition to Wind Up has been filed against the company in The Gazette. It's a while until it's time for the next instalment of their maintenance work, but as you can imagine I'm rather concerned by the time it comes around there may not be a company to carry out the maintenance I've paid for!

    Is there anything I should do to respond to this petition? Can/should I register as a creditor even though I am only owed performance of services rather than cash?

    As an extra fun dimension, the public website for "Acme" has recently been subtly tweaked so they now advertise as "Acme Group Ltd", which seems to be a shell company that was registered with a different name and purpose then renamed to the "Acme" overnight. Does this mean that "Acme Services Ltd" has "ceased trading"? To convert the contract for services I think I might not receive into a cash debt, could I take them to court for anticipatory damages caused by their cessation of trading?
