In October 2018 I bought a "Fitbit Charge 3" fitness tracker device from Argos.
This morning whilst removing the device the clasp of the strap came away from the strap itself, this was due to the rubber band holding the clasp breaking.
I took the item to Argos and asked for a replacement. They directed me to Fitbit and said it was the responsibility of the manufacturer to replace/repair. They also said that the strap could have broken if I caught it on something.
My understanding is that the Retailer is liable for the warranty under the Consumer Goods Act but the onus is on me to prove the item is/was faulty. My opinion is that a fitness device intended for exercise should be more durable and last longer than 8 months.
I could go via Fitbit but this would involve sending the item away and waiting for a replacement. I would much rather get a replacement directly from Argos. I did suggest to them that they could give me a £24.99 replacement strap instead of a new replacement device.
What are my rights/options here?
