  • I submitted my Witness Statement late

    So I have a civil hearing set for September 10th. Originally it was set for August 4th, but the Court failed to take into account my available dates noted in my allocation questionnaire and the Court reset the hearing date.

    Originally the Witness Statements were due on May 5th, and it was my understanding that the dates would all be moved accordingly, which meant the new submission date for them would have been June 10th. Yet now it seems that this submission date did not get changed, only the hearing date.

    I asked the Court why and they have not given me an answer. I sent the Witness Statement on the new date, according to what I thought and was led to believe would be the new date.

    I am concerned now because I have read that the other side could make trouble with this late submission.

    I have read elsewhere that in the interest of getting things done and dusted, speedy trials, etc, the Judge will probably allow this late submssion. Can anyone advise please?

    Surely all dates would/should be moved?

        The court can tell you whether your WS has been filed & accepted.
        If it were me I'd chase them up again to get a definitive answer.
        Do you have an email address for the court?

          charitynjw Just been told that the Court has a backlog but that it will be filed and accepted imminently.

          I think my question is what if the other side makes problems about the late submission at the trial?

            I would doubt that it is going to be an issue.
            The other party had the opportunity of applying for your late submission to struck out; it would appear that they didn't do so.
            In any case, it would appear that the court is happy enough with it.
