  • Car not fit for purpose

    Hi All,

    Looking for some advice please on a car that has turned out to be a bad one .

    Bought a car for £6500 cash on debit card in Feb this year.

    After 33 days it broke down. Oil pump failure, causing damage to turbo and other engine parts. Returned to dealer who offered to do repairs FOC and provided courtesy car.

    Car was in their garage for 4 weeks and they claimed to have replaced the entire engine and associated parts, although could not provide any invoices or paperwork to prove this.

    Picked car up yesterday and was great for about 2 hours until it broke down again on the motorway, cut out,complete engine failure and would not restart.

    Recovered to the dealer again.

    AA man said he thinks it's a sheared bolt on the timing chain pulley and this will likely have caused significant engine damage again. Also said it's highly likely to have been caused by bad workmanship on the previous repair.

    Obviously I'm not happy and have lost confidence in the car and would like a refund after 2 major engine failures after only a month on the road.

    My questions are:

    As the first failure happened after 33 days, just outside the 30 day period, do I still have the same rights to return it or is it more complicated?

    As the garage attempted repair initially, do I still have the right to a refund as I accepted this repair?

    If the second failure was due to bad workmanship, does this mean that the car was not fit for purpose still or does this complicate matters?

    I have not heard back from them since it went back in yesterday and I have a courtesy car again. What is the process now for requesting a refund? Do I have to give them a chance to fix again? Should I give the courtesy car back first? Should I take ownership of the car and get it inspected independently?

    I just want a refund now with as little hassle as possible, it's been a nightmare.

    Hi and welcome

    As the car broke down within 6 months of purchase, but after 30 days, it is deemed the fault was present at time of purchase.
    The dealer has the right to one chance of repair (which was exercised).
    This repair was unsatisfactory so you have the final right to reject the vehicle for a full refund less an amount for usage.
    Suggest you write setting out your position

    Note the car is unsatisfactory rather than unfit for purpose

    As an aside they claim to have changed the engine.
    Did you check if this was so (change of engine needs to be registered with DVLA)?
