  • Assisted Move sale mis-managed by the builder's service provider

    Hi,

    We were using an Assisted Move scheme with one of the main UK residential builders (Builder) to sell our flat and buy a new build one. The sale of our old flat was handled by another partner company (Partner), but the new build reservation and Assisted Move agreement were with the Builder. The buyer for our flat was quickly found, but the Partner company mis-managed their expectations re completion date - they told them the completion will happen "quickly" and didn't advise them about possible delays due to Builder's construction schedule. When the delays happened, the buyer withdrew, upon which the Builder cancelled our reservation and put the flat we wanted to buy back on the market. As the transaction fell through due to the mismanagement by Builder's partner company, we asked the Builder to refund our reservation fee (which they did after multiple requests) and refund our conveyancing costs (which they flatly refused to and asked us to take it up with the Partner company). We feel that since all our agreements were with the Builder and they directed us to the Partner company which mis-managed the sale of our flat under the Assisted Move scheme, we lost money due to bad service provided, ultimately, by the builder, and therefore we are entitled to compensation from them. Are we in the right?
