  • Clarification of duties on ltd companies to list their details correctly

Recently had some rendering work done and it was sold on the basis that the work would be guaranteed. The guarantee has just been delivered and it is in the name of a ltd company that does not currently exist on companies house, though is quite close to the original company name (Weather Coat-Systems UK Ltd v. Weathercoat Systems Ltd ). No Company Registration number is given. There have been a number of other issues with the company and the warranty that I won't bore readers with here which make me doubt that this was an innocent mistake. I believe they are doing anything to convince me to pay the balance of the monies due for the job. My question is does their failure to properly identify their company on their guarantee open them up to sanction by companies house, trading standards or similar?

Pretending to be a limited company is potentially fraud.
This is because a company is a distinct legal personality and by pretending to be incorporated they are pretending to be an entity that does not exist.
The most appropriate way to deal with this is to make a complaint to trading standards - www.tradingstandards.gov.uk/
