Hi Legal Beagles, a big fan here.
I have been gearing up for some time to take on two separate European airlines - a luggage claim against Eurowings, and a ticketing issue with Croatia Air.
It USED to be that I thought I was going to have to use the EU Cross Border procedure for both. Now it seems I need only take on Eurowings this way - a German company.
I have a question about that -
1) from what I have read, it seems I only need to complete and send EU cross border form A (the Claim Form) along with supporting evidence, to my local Court. They then send to the Defendant. I thought I would also have to send in the form A in German - but maybe I am wrong, as I cannot find reference anywhere to having to do so - just that I might "be asked to pay to translate later, which is a recoverable fee should I win." Can anyone clarify this? Also - do I need to send the Form A in duplicate or does one copy suffice?
And, regarding Croatia Air:
2) I have now found a Croatia Air on Companies House website, which I must have missed before. It is under company numbers BR011961 and also FC017999.
Can someone take a look to confirm that these look like active companies and are the airline I am litigating against? There are a few outstanding charges against them? I want to make sure I am taking on the right entity and they are not closed, etc. From how they look I think litigation in the Small Claims UK Courts is the way to go.
Thank you sweeties I very much appreciate any help
p,s, EDIT: Lufthansa own Eurowings and do have a service address in the UK - could I take them on instead of Eurowings? Eurowings are their subsidiary company.
