  • Is it legal to sell an unused seven year old trailer as a new trailer?

    I was sold a trailer by an agent of the manufacturer in January 2014 whom I met at a trade stand. I understood I was buying a brand new trailer.

    Within six months faults developed and between the manufacturer and their local repair centre the service was so shocking that to date, despite much correspondence, none of the faults have been rectified.

    Earlier this year a friend's horse damaged the trailer and the friend took it for a quote for repair. He advised the repair company with regard to spare parts that the trailer was bought in January 2014 so would be a 2013 model. The repair centre looked at it and pointed out that it was actually a 2007 model and hasn't been in production since 2009.

    Is it legal to sell an unused seven year old trailer as a new trailer?

    As far as I'm concerned I bought the trailer from this manufacturer because the resale value is good but it's seven years older than I thought. One (unresolved) fault in particular is likely caused by age - perished rubber.

    Might be difficult to do something now given the passage of time. My view is that it should have been advertised as "like new but unused" - it may well have been the showroom model but they have certainly been economical with the truth.

      Thank you ploddertom. So is there a deadline to having recourse/rights when you've been duped? What is that deadline?
      The manufacturer consistently failed to meet any reasonable deadline to get parts to the local repair centre. How much time should I be reasonably expected to spend on chasing them to get the work done? It is a sixty mile trip, a day off work, a wasted day, every time they don't fulfil their commitment to get the parts to the repair centre.
