  • Capital One Refusing To Default

    I would like some advise please on Capital One.

    I have not made any payment on my account for over a year due to having financial difficulties, which they are fully aware of.

    I had sent to them a detailed income and expenditure they requested.

    They are fully aware my main source of income is ESA at £110 per week.

    Although they have agreed to freeze my account, and not to incurr any charges, however they are destroying my credit file by marking it "late repayment" every month.

    I am concerned that Capital One are just refusing point blank, for no reason, not placing my account into default.

    As it is more damaging to keep marking "late repayment", I now cannot obtain any further credit as a result (not that I want credit anyway).

    Can anyone advise me what to do.

    Would I therefore have a claim under the Data Protection Act for unlawfully refusing to place the account into default, and thus affecting me from obtaining further credit!?

    I cannot understand why they are refusing to default me considering its been over a year since last payment was made; surely that is a breach of FCA guidelines not to place the account into default!?

      we are here for advice ... but we are all pretty busy. It's always nice to give the Beagles a chance to see your thread and respond, or even to bump the thread (or report it) so it's back at the top of the forum again xx
